The Alberta Utilities Commission (AUC) may impose an administrative penalty if it determines, after a hearing or other proceeding that a person has contravened or failed to comply with any provision of the Alberta Utilities Commission Act; any other legislation under the jurisdiction of the AUC; any decision or order of the AUC or any commission or ISO rule or reliability standards. In the above circumstances, the Commission may also impose any terms or conditions or a person that it considers appropriate.
An administrative penalty may be either or both of the following:
(a) an amount not exceeding $1,000,000 for each day part of a day on which the contravention occurs or continues;
(b) a one-time amount to address economic benefit where the AUC is of the opinion that a person denied an economic benefit directly or indirectly as a result of the contravention.
The Commission also has the authority to make rules prescribing the form and content of specified penalties for the contravention of ISO rules or reliability standards.
