The Alberta Utilities Commission has authority to make rules regarding specified penalties. Specified penalties are penalties that are imposed by the Market Surveillance Administrator (MSA) if the MSA is satisfied that a person has contravened a reliability standard.
The AUC may prescribe the form and content of notices of specified penalties, the amounts of specified penalty (up to $100,000 per day) and the limitation periods for giving notice of specified penalties.
The AUC approved administrative amendments to Rule 027 on February 14, 2017. The changes made were communicated to market participants and interested parties in Bulletin 2017-01, which included a blacklined version of the rule identifying the changes.
