Rule 011 - Rate Application Process for Water Utilities 
 

On August 7, 2007, the Alberta Energy and Utilities Board (EUB or Board) issued Directive 053 which set the rate application process for small investor-owned water utilities. The purpose of Directive 053 was to provide efficient regulation while ensuring that a utility’s prudent costs are recovered through just and reasonable rates charged to customers.  With the replacement of the Board by the Commission, EUB Directive 053 was re-issued as AUC Rule 011. The purpose of Rule 011 is to provide an efficient, cost effective process to mitigate the full regulatory process which is often costly for small water utilities. This is exacerbated due of the small customer base over which costs are collected and that water utilities generally do not have the staffing and expertise required for the complex rate hearings.

Directive 053 called for a review of the process after July 31, 2009.  As that date has passed and as there now have been sufficient applications to evaluate the Rule 011 process, Commission staff began the process of reviewing Rule 011 to identify opportunities for improvements to the process or possible elimination of Rule 011.

The review process commenced in May of 2010 where a survey (questionnaire) was sent to parties who had participated in the Rule 011 process. From the comments received from stakeholders, the Commission has proposed changes to Rule 011, and is now seeking comments from parties on those proposed changes. As outlined in Bulletin 2010-29, once the comment portion of the review is completed, the Commission will post a comment matrix consisting of all stakeholder responses to Bulletin 2010-29.
