The Alberta Utilities Commission has authority to make rules regarding specified penalties. Specified penalties are penalties that are imposed by the Market Surveillance Administrator (MSA) if the MSA is satisfied that a person has contravened a reliability standard.

The AUC may prescribe the form and content of notices of specified penalties, the amounts of specified penalty (up to $100,000 per day) and the limitation periods for giving notice of specified penalties.

The AUC conducted a rule review and stakeholder consultation of Rule 027 to update the penalty tables to reflect the current version of the Alberta Reliability Standards and to provide stakeholders with the opportunity to propose changes to the rule. More information about the consultation can be found in Bulletin 2020-03
